These terms govern your access to and use of OZFINDA (ozfinda.com.au). Please read them carefully. By using the site or creating an account you agree to be bound by them.
1. About us and these terms
ozfinda.com.au (the "Site", "OZFINDA", "we", "us" or "our") is operated by Pixel Online (ABN 34 297 542 192), a business based in Australia. OZFINDA is an online directory that helps people find local Australian businesses and lets business owners publish and manage a listing.
These Terms & Conditions (the "Terms") form a binding agreement between you and Pixel Online. If you do not agree with any part of them, you must not use the Site. They apply to every visitor, registered user and business owner.
2. Definitions
- "Listing" means a business profile published on the Site, whether created by us, imported from public sources, or created and managed by a business owner.
- "Owner" means a registered user who creates, claims or manages a Listing.
- "Content" means any information, text, images, reviews, logos, links or other material submitted to or displayed on the Site.
- "Plan" means a paid subscription or feature (including featured placement) offered on the Site.
3. Eligibility and accounts
You must be at least 18 years old and able to form a legally binding contract to register for an account. If you register on behalf of a business, you confirm you are authorised to bind that business to these Terms.
You are responsible for keeping your login details secure and for all activity that occurs under your account. Notify us promptly at [email protected] if you believe your account has been compromised.
4. Listings and claiming a business
Some Listings are created by us from publicly available information so that businesses can be found before their owners join. If you are the owner of a business, you may claim its Listing through our verification process. Once claimed, you are responsible for keeping the Listing accurate and up to date.
We may edit, relocate, merge, unpublish or remove any Listing at our reasonable discretion — for example where information is inaccurate, misleading, duplicated, unlawful, or where a business has ceased operating.
5. Your content and responsibilities
You are solely responsible for the Content you submit. By submitting Content you warrant that:
- it is accurate, current and not misleading or deceptive;
- you own it or have all rights and permissions needed to publish it, including for any logos, photos and trade marks;
- it does not infringe anyone's rights or breach any law (including the Australian Consumer Law and the Competition and Consumer Act 2010 (Cth)); and
- it is not defamatory, offensive, fraudulent, or designed to mislead consumers.
You grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, adapt and display your Content for the purpose of operating, promoting and improving the Site. This licence continues for Content that remains on the Site after your account is closed (for example, reviews left by others) but otherwise ends when the Content is removed.
6. Acceptable use
You agree not to:
- post false, fraudulent, misleading or spam Content, or impersonate any person or business;
- submit or solicit fake, incentivised or self-authored reviews, or reviews you are not entitled to leave;
- scrape, harvest, copy or republish the directory or its data without our written permission;
- interfere with, probe or attempt to gain unauthorised access to the Site, its security or other users' accounts; or
- use the Site for any unlawful purpose.
7. Reviews and user content
Reviews must reflect a genuine, first-hand experience. We do not pay for reviews and we do not allow businesses to write, alter or remove reviews about themselves. We may moderate, decline to publish, or remove reviews that we reasonably believe breach these Terms, but we do not guarantee to monitor all Content and we are not responsible for opinions expressed by users.
8. AI assistant and concierge features
Parts of the Site use automated and AI-assisted features (such as the business concierge and FAQ answers). These features generate responses from available information and may be incomplete or inaccurate. They are provided for general convenience only and are not professional advice. You should confirm important details directly with the relevant business before relying on them.
9. Fees, plans and payments
Some features are paid. Pricing, billing, cancellation and refunds are described in our Payment Policy, which forms part of these Terms. Where there is any inconsistency about payments, the Payment Policy prevails.
10. Intellectual property
The Site, its design, software, branding and content (other than Content owned by you or other users) are owned by or licensed to Pixel Online and are protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from any part of the Site except as expressly permitted by these Terms or by law.
11. Third-party businesses and links
OZFINDA is a directory. We are not a party to any dealing, transaction, quote or contract between you and a listed business, and we do not endorse, guarantee or take responsibility for any business, its goods or services, or the accuracy of its Listing. Any arrangement you enter into with a business is solely between you and that business.
12. Disclaimers
We provide the Site on a reasonable-efforts basis and aim to keep it available, accurate and secure, but we do not warrant that it will be uninterrupted, error-free, or that any Listing or information is complete or current. To the extent permitted by law, the Site and its content are provided "as is" and "as available".
13. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for a breach of a non-excludable guarantee can be limited, our liability is limited (at our option) to re-supplying the relevant service or paying the cost of having it re-supplied.
14. Limitation of liability
Subject to section 13, and to the maximum extent permitted by law:
- we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, goodwill, data, or business opportunity; and
- our total aggregate liability arising out of or in connection with the Site or these Terms is limited to the amount you paid us (if any) in the 12 months before the event giving rise to the liability.
15. Indemnity
You agree to indemnify Pixel Online against any loss, liability, cost or claim arising from your breach of these Terms, your Content, or your unlawful or negligent use of the Site, except to the extent caused by our own breach or negligence.
16. Suspension and termination
You may stop using the Site and close your account at any time. We may suspend or terminate your account or any Listing, with or without notice, if you breach these Terms, if required by law, or to protect the Site or other users. Sections that by their nature should survive termination (including sections 5, 10, 12–15 and 18) will continue to apply.
17. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
18. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that jurisdiction and the courts able to hear appeals from them.
19. Changes to these terms
We may update these Terms from time to time. The current version is always available on this page, and the "Last updated" date shows when it last changed. Material changes will take effect when posted; your continued use of the Site after that means you accept the updated Terms.
